Not misinformation. He was found liable in a tort case -- the standard is that it is more likely than not that he did what he was accused of. No trial gives a definitive result. Only mathematics can do that.

Carroll claims Trump stated her allegations were a "con job," and she only trotted them out to increase sales of her book. Seems close to an opinion, yet it also could be defamation per se, because it attacks her as a writer and that is her profession. I'd have to see the jury instructions to find out what the plaintiff and defense agreed to.

@paulweeldreyer7457 I wasn't listing the elements of a defamation case, I was contrasting a potentially defamatory statement with something like a simple denial of an accusation, which is never defamatory. I'll have to look up the complaint and see what her claim was.

@jirikurto3859 Well, given that a jury believed her allegations and credited her testimony, that is sufficient legal proof that they were not a con job.

@jirikurto3859 You asked, I answered. If what you say is accurate, that means Trump is probably intellectually dishonest as well, and thus may be lying now. Especially when he has a clear and obvious interest and motive to lie.
