  3. @williammorris3815  It can mean a lesser charge, yes --- because the perpetrator cannot form the requisite mens rea for the more serious charge. It's never a complete defense.

  5. Well, that makes all of this more potentially dangerous. If the FBI poses a threat, it's also incapable of protecting us from any real threats. They're too busy doing the wrong thing.
