@electricpaper269 Equal access to education with men: do you think that didn't open all other areas to hard work and talent as well? Higher education is more important to women than men because we usually can't work in construction, etc., and are often less well suited to law enforcement or military careers, or careers in sports --- with obvious exceptions.

@JiggyJones0 Exactly. In most circumstances, there is no case. "Misgendering" is no big deal. In some contexts, however, it could objectively endanger a person and put them in reasonable fear of harm, or of immediate job loss. Case by case.

In the US, intentional infliction of emotional distress is case by case and has to overcome a presumption that it is First Amendment protected speech, just like defamation must. It is a civil matter, and could lead to more than a $11,000 recovery to the actual, adjudicted victim, when it really happens and the victim proves it in court. It is NOT a crime. Good law.

@PeterMoss54321 How about starting your own property management business, which requires access to credit? How about being admitted to a prestigious college and majoring in education, and having more opportunities for good jobs in education, including teaching in private schools, when most women had to go to a second-tier teachers' colleges, regardless of ability?

@GrimSower Yes, there is a video about that case as well. Based on what a law student who was there said about it, it is beyond absurd. Strossen and Chemerinsky have both written about free speech on campus and in general. Great, great books.

@sorbabaric1 The OP was a blanket statement that is literally incorrect as a matter of law. As an example, if laws benefiting veterans happen to exclude more women than men, they are nevertheless constitutional. If minimum wage laws protect immigrants more than all others (even much more), they are nevertheless constitutional. If women live longer and draw more Social Security benefits overall than men do, that is nevertheless constitutional. See? That's why there are law schools, and they should protect free speech fora on campus. It's not so simple.

@FrydClips If a university is a public institution, it IS the government. If not, it is still governed by Titles VI and IX if it accepts federal funds, and also has a contractual obligation to its students to maintain designated First Amendment fora as promised, OR to let students know in advance that it has closed down such fora and imposed rules that would encroach on some constitutionally protected speech and expression. A private university can do that, as long as it doesn't discriminate. You are welcome.
