Why don't you forthrightly say that you may one day argue before the Supreme Court, or submit a petition for cert, or a brief, and hence you just can't talk about the intelligence of Justices, for the sake of your (future) clients? Why not just say that lawyers really can't do that, even when they'd love to, because there are real people and their welfare to consider? Sheesh.

Scalia was furious when the Court ruled people could not be executed for a crime they committed as a minor. The death penalty for heinous juvenile acts was one of his biggest causes, and he said some ugly things in those opinions/dissents in promoting it. Scalia wasn't smart. I guess Posner's takedown is ignored because Posner himself is considered odd?
