The quote from Justice Jackson is exactly how law school teaches you to fashion hypotheticals. Why is one categorical classification valid and another a constitutional violation? A lawyer is supposed to be able to explain why to the Court.

This is exactly how questions are examined in law. The lawyer's job is to show how these cases are different.

Same for Justice Barrett. They've both proved themselves. (BTW, I've never voted for a ticket with Biden on it. I saw through that 16 years ago.) Try reading some opinions and see. Or, let cable television decide for you. 😂

@Mal35m-ub6uj Look, they won't let me explain. I get ____ right away. Her question was proper. This is exactly how hypotheticals are framed. The lawyer is supposed to explain the legal distinction. Her question does NOT imply SHE thinks they are the same. She knows they're not. (Read her concurrence in the January 6th case. She voted with conservatives.)

@charlesprice7608 What do you mean by "four years of constitutional law?" I know of no law program, JD or LLM, that offers "four years of constitutional law." I was a federal appellate clerk. I do know what I'm talking about.
