The defense attorney who forwarded that material to the other side better call HIS malpractice insurance carrier.

@highpriestofgavinalmightyh1304 I guess you don't understand the concept of default then. I hope the issue will be thrashed out on appeal. If you're referring to his defense attorney's release of confidential material to the plaintiffs, he can be held liable for that. It is gross malpractice.

How do you know he didn't deliberately default, as a litigation strategy, to bypass the issue altogether? These parents had a right to their day in court, just like anyone.

A default essentially means Jones refused to mount a defense. If what he did does not amount to refusing to defend (which itself could be a litigation strategy), then entering default was not proper. There are other ways to enforce court orders.

@ Joao Sousa (sorry, this was to thewrong person originally) Well, the actual lawyers who are among the most popular on YouTube make glaring errors all the time. Kim wasn't wrong in what she said, actually. More like incomplete. But a default is not immune to being overturned on appeal. Alex Jones wanted to default and did it deliberately, for all we know. Or, on the contrary, the judge overstepped by entering default. Not evident on its face either way.

Kim was the only person I know who grasped Depp v. Heard was not a men's rights case or a MeToo case. It was not about the (sordid) people but about a piece of writing. It was a First Amendment case.
