  3. About 50% of all economic activity is mediated in some way by government: government contracts, tax subsidies, dependence on the military to offshore jobs and import the product safely, and benefitting from government-funded basic research and technology, are just some major examples.

  4. Hard question. The standard of review for any such statute would depend on the power invoked, and how compelling the reason was. It could only be prospective. But there is less problem with setting standards for government contracts, such as having to justify layoffs first, in order to bid, with stock buybacks being presumed to be evidence that layoffs are not justified.
