  1. No, the law says "life, liberty, and property". The "pursuit of happiness" is in the Declaration, which is NOT part of US Law. The right to detain suspected shoplifters is recognized by the courts as "shopkeeper's privilege". If no other harm is done to them, the matter is settled to the court's satisfaction by their simple release. Court's are reluctant to adjudicate any civil harm for detainer, even if physical. This is because store's need some way to determine ownership of merchandise still on their premises. That's WHAT YOUR RECEIPT IS FOR!!
