+Drokker Elq They just aren't bothering with you, they do have the right by law.
1
Drokker Elq Hold you against your will, sure, if they have probable case that you were stealing. Search you, same. Cavity search, technically yes, if they have probable cause. A badge doesn't grant special rights. These are the normal rights of citizen's arrest.
1
Drokker Elq All empowered employees of the store have the same right to detain and search. The police are NOT a "different matter", THEIR power to do the same comes from the same law.
1
Drokker Elq By law. Anyone who owns anything, or their agent, can act to recover it if stolen by means of arrest. Arrest includes search.
1
Drokker Elq Nope, they call the police anyway. No matter WHAT you want. Your lawyer will charge you a lot of money and you will LOSE!! Probable cause only applies to one person at a time.
1
Drokker Elq You can disagree all you want, they will still hold you down and do it. Look up "probable cause". They don't have to search everybody, just those suspected of crime.
1
Drokker Elq That's not merely police officers. That's anybody. Find a better law book. Badges don't confer extra rights. That's a first principle of Constitutional law.
1
Drokker Elq No, I'm NOT a troll. A troll is someone who starts trouble and then sits back to laugh at both sides.
1
don sligh jr Wrong, I've done it myself many times AND signed the ticket as arresting officer. Any property owner or their agent does that with shoplifters.
1
don sligh jr If that's Walmart policy, then so what? They DO have the RIGHT to by law!! You go ahead and try to jump the exit like that and see where you wind up! I saw a kid at CostCo two months ago try that and he was down on his face in the parking lot last time I saw him.
1
Drokker Elq Do that a couple times and they'll ban you, and with good reason.
1
Drokker Elq Then don't shop anywhere, because EVERY seller has the right to make sure that what leaves their store is paid for.
1
Drokker Elq The laws of the various states are fairly uniform about this. I have done the legal research, I know of no exception.
1
Drokker Elq No, that's NOT the way it works. http://www.quickanddirtytips.com/business-career/legal/store-security-and-your-rights Stores are NOT bound by the 4th Amendment, as their action is NOT a state action.
1
Drokker Elq You didn't address your own question about door inspections and receipts, you only addressed overt shoplifting.

***** No. You just got away with it because they didn't want to bother. Most all states have a commerce law clause that says that a sale is NOT complete until checked out at the door of the store and you exit in good standing with the store ownership or their agent. It affords stores the right to check all packages exiting for unpaid merchandise. So you see, it isn't really "yours" till you've done that. This makes perfect sense, after all, who do you believe as to whether an exchange was a sale or a robbery? Answer: The party who relinquished the goods. Once again: http://www.quickanddirtytips.com/business-career/legal/store-security-and-your-rights

Dan Tee Try it.

+KOREY STOREY Actually ANY store can search your stuff as you leave. That's a condition of shopping there.
1
don sligh jr Education. Also Legal Aid Service research experience.
1
don sligh jr And, you got nuthin'.

Colin Alba No. Commercial code says sale occurs when two parties agree that the property has changed ownership, and further states that this means once you have left the premises with a receipt, and they MUST give you a receipt by law. But the ownership has not transferred till the agents of the seller validate the existence of your receipt as you exit. That is what they are doing. Before they say it is yours, it is theirs. Reasonable.
1
Colin Alba I just told you the truth about the law, I ran a store once, I have never even been inside a Walmart.
