  5. This now becomes a chess game. If it advances to SCOTUS, that court is divided 4-4, which means trump looses by default (lower court rulings stay in case of SCOTUS deadlock). So ideally it would wait for the 9th justice, but that may not be possible. Whatever happens, it increases opposition to Gorsuch, since the dems will realize that the 9th justice will tip the court over in Trumps favor. This will be complex and interesting. If you listened to any of the live stream of the case before the 9th, you will realize that Trumps lawyer was incompetent. Trump didn't pick him, he was there from the previous administration.
