  1. The USA basically follows the law of the sea, because it has been unable to ratify the treaty. The Republican party continues to veto the ratification at every opportunity as they see it as a "violation of US sovereignty". They are basically holding the US government hostage. So no, it's no hypocritical of the USA since the majority of the US Congress want to ratify the UN Law of the Sea.
