krgrimm Keep in mind corporations have been considered people since the early 1500s in English common law, and under the US Constitution, if corporations are not people...they aren't subject to criminal law.
That's right. While you can hold an object civilly liable such as asset forfeiture, you cannot hold a non-person criminally liable under US Law, and it's always been that way. Thus, if corporations cease to be people, they become entirely above the law for criminal acts. The only person you could go after would be the criminal actor individually.
Example: Say Dave, a 42 year old driver for Monsanto with 2 kids, a mortgage, and just 2 more years of student loan payments to make, is ordered to dump 8 million gallons of industrial waste on your lawn or he'll lose his job, and he really needs his job so he does it. Subsequently, you and your loved ones contract supercancer and astonishing medical bills, along with your neighbors and closest friends. If corporations are not people, what can you do? How do you go after to pay for these crimes?!?.....not Monsanto, they're a non-person and thus immune, and since you can't go after them, the only person you can get a judgement against is poor Dave. Good luck getting the millions you're owed out of his negative net worth after you destroy his family.
It is this revelation that made even OCCUPY WALL STREET publicly state they believe corporations are people for purposes of law.
