Benitez is the only judge in California standing in the way of these unconcstitutional "laws." I hope he has a large security detail to protect him from a Democrat "suicide" attempt.

Agreed. As soon as a "law" is determined to be unconstitutional, all those who signed it should be removed from office immediately for breaking their oath to uphold and defend the constitution.

I would argue that all constitutionally protected arms are for assault. The 2A doesn't protect our right to hunt squirrels or shoot paper targets. Our right to keep and bear arms is predecated on the idea that we have a right to use lethal force to defend ourselves, our families, our property, and our Country. We will never have to fear a paper target uprising. Therefore, by defining a specific type of weapon as "assault weapons" (the only kind protected by the 2A) and then banning them, the politicians involved have broken their oaths at best and committed treason at worst.

Eman Gman I agree. They're all potential assault weapons. Any ban on anything a typical militiaman could use as a weapon is unconstitutional. In other words, their very use of the term "assault weapons" in their bills means they should be immediately disregarded for being unconstitutional. The only thing the 2A protects is our right to weapons for assault/counter-assault, not tools for hunting.

"Military style" huh? That's a funny term that misleads the ignorant. I have a "military style" sheath knife, too. However, since it's not an actual "military spec" knife, it would never be issued to soldiers. It only looks like a military knife but won't function the same (hence the word "style" is used). Likewise, an AR-15 does not function the same as the M4 or M16, so they are just look-alikes. The sad part is, California's ban included rifles that didn't even look like any existing military spec rifles, so couldn't really be called military "style."
