  1. Banksy never asked for planning permission because he doesn't own the building on which he painted his mural. However there is currently a firm who having discovered they have a Banksy on the side of their building are retrospectively applying for planning permission so it can legally remain.

  2. It's not your right to paint it on the side of a building without having checked to see if you need to get planning permission first. Having a flagpole is ok, you don't need permission.

Interesting there is a firm who having discovered that a Banksy is painted on the wall of their building are now applying retrospectively for planning permission so it can stay !
