Wrong, have you ever heard of copyright ? However hymns are so old they aren't protected by copyright and are now in the public domain. In short no one owns the rights to them, unlike say a Beatles song. Copyright infringement is usually a civil matter, not a criminal offence and not a Police matter.

Me too, but you could be sued for copyright infringement if it was a Beatles song as that will not be in the public domain will have an owner and be protected.
