  1. I think you are referring to posse comitatus, however, that only applies IF the branches of the federal US Military attempt to perform a police action upon American citizens. There are a couple of exceptions, one of which is the formal declaration of martial law. The loophole I was wondering about is if you could declare that the members of the Texas National Guard should be formally classified as US citizens. If that were the case, then posse comitatus would make it illegal for the federal US military to perform a law enforcement action upon the Texas National Guard.
