Objection: absolutely nowhere in the record is there even a hint Congress considered the current situation of photographers taking pictures of people as they go about their private daily live and forbidding their use. Taking a photo of a celebrity on the red carpet at a premier is one thing, taking a picture while shopping at Whole Foods is quite different. The court needs to provide a privacy exception. The person in the photo must be useable by the people in the photo, even for commercial use. The photographer doesn't gain control of your image be cause they take a picture of you.
