Open Window was the reason she fell.. So no point blaming the Nanny, She would have looked for her after getting back in the Elevator and probably couldn't find her. The person who must be sued is the Buikding Owner and Whoever had the Windows open. If there was no open Window, The Kid would have been found even if it took many Hours.
