  1. All LTTs videos make money so they don't have to be using it for any particular purpose for it to be commercial. If they wanted to treat it as promotional, they should have gone to the developer to make arrangements. However, I don't think there was anything malicious going on here and your points about the commercial requirements not being advertised well enough are well made.

  2. The thought is that businesses will be using the software to make money so can afford to pay (though yes, some commercial licenses are disproportionately expensive). Also, personal licenses are often seen as loss-leaders. Once people are familiar with the software, they are more likely to use it in a business, generating real income. Personally, I tend to lean towards open source anyway.
