@seanpatrick1243 what does it have to do with it? If the Polish Supreme Court decided the Polish Constitution is inconsistent with the treaty, then the EU has grounds to say they never joined. It's a legal interpretation. That has been applied in many treaty cases throughout history. It's akin to lack of capacity to enter a contract.

This is how the US Supreme Court would rule if the US signed a treaty that violated the constraints of our Constitution. The treaty would be void. Our Supreme Court has already held that our Presidents have the authority with the stroke of a pen to cancel any treaty and there is no doubt based on our legal precedents that the courts could do the same if a treaty in anyway violated the constitutional authority of the federal government.

In the US we answered the question of which is supreme, the constitution or a treaty a long time ago, and the answer was the Constitution. If a treaty is inconsistent with the Constitution, it is cancelled.

@LudvigIndestrucable I am pointing out the legal precedents I am making no judgments as to the right or wrong course of action. Historically what the people want in any society even a supposed democracy is always secondary to what the moneyed interests in charge of the country want.
