Similar to how the federal income tax was introduced to make up for the loss in alcohol sales due to that prohibition. After the alcohol prohibition was removed the income tax remained.

@SuperBknudsen Do terminal ballistics matter to criminals and mass shooters? Isn't nearly all crime committed at ranges where a 9mm would be just as effective as a 5.56 if not more with 9mm hollow points that'd exert their entire energy in the target than 5.56 that'd get in and out and spend most of its energy outside? For concealment purposes 4 extra inches don't make that much of a difference. IIRC that mall shooter last year who was stopped by Elijah Dickens simply had the upper and lower disassembled and he reassembled them in the bathroom before coming out and starting to shoot. Regarding magazine capacity, the standard Glock mags have 17+1 rounds flush with the pistol grip and doing a mag change by dumping it and sticking a new one and racking the slide takes 2 seconds (or less if you're well trained) for a total of 34 rounds, so I am not sure how's that too big of a tradeoff either.

No because it doesn't have a stock. "Rifle" legally means it's designed to be shouldered when firing.
