  1. The whole "shouting fire in a theater" exception to free speech actually is incorrect, at least as far as people tend to use it. It's only illegal to shout fire in a theater if it can be proven that you knew there was no fire. And it's typically pretty hard to prove the affirmative knowledge someone has like that, if you were to actually be charged with that, you could just say you thought you smelled smoke. It's not illegal to be a spastic Chicken Little, it's just annoying.
