Devil's Advocate:  I imagine the judge meant to say "lethal rounds" not "lethal shots."  A lethal shot is one that kills a person, a lethal round is a round capable of causing death.  Not necessarily one that inflicts death, but one that is CAPABLE of inflicting it in the correct circumstances.  You are right, this judge is a moron, this behavior is only acceptable in over-the-top action films, not in real life.
