  1. Two things. One, our founding father never wanted a standing military. They knew that having one meant, as David likes to say, that it'd be treated like a hammer, and everything starts looking like a nail. Two, this is exactly the sort of thing our founding fathers were afraid of, someone gaining too much power and doing what they like instead of what is allowed by law. This is why they wanted a congress and judiciary to act as checks on presidential power. Because congress spent decades abdicating their responsibilities by investing more and more power in the presidency, this was all inevitable even if it was entirely avoidable.
