DHS may not have been formed in 1996, but some earlier laws are still on the books today that have to be followed unless those laws are set aside. It doesn't matter when they were written if they are the law. This jurist has a big problem trying to convince the Supreme Court that laws don't have to be followed just because they were made before an institution existed. Unless something supersedes or vacates the existing law, how can she argue "we don't feel like doing it and don't feel like we have to, your honor". She acts like Resident Biden or Mayorkas are not being dramatic in their actions.
