Many serious Charter violations occur routinely without attracting comparable public or media spotlight, while a comparatively narrow and novel legal interpretation about protected bike lanes has captured exceptional attention due to its legal novelty, symbolism, and political context.

Cycling is a legal and valid form of transportation, and under Ontario’s Highway Traffic Act, bicycles are classified as vehicles — meaning cyclists have the same rights and responsibilities as motorists. That should be enough. There is no proven need or justification for granting bikes special treatment or infrastructure beyond what is already provided to all traffic participants. The current push for protected bike lanes on specific roads — and especially claims that they are constitutionally required — goes beyond equal treatment. I do not agree that these lanes warrant special legal status or privileges, nor that their removal violates Charter rights. Cyclists are normal traffic participants and should follow the same rules and share the road like everyone else.
