People must tell them you will only be searched by a uniformed police officer after the store has alleged You have stolen something and named the item. They have NO POWER to do this. We spoke to M&S staff who told us that people often just fill bags or clear clothes racks and no one stops them.

@KevandPerry2 I am retired police. IF they have good reason to suspect you and that is the point. They cannot search you as you say.
7
@stephenmason5682 They can ask, that's all, if they want to detain you they need evidence. I would just walk out and tell them to call the police if they wanted to.

@geordiewishart1683 Yes it is only committed once you have left the store. Sometimes people pick up an item, put it in their bag (especially elderly people) and then realise but there was no intent. Sometimes they even leave the store and a bit of investigation shows there was no intent. So that is incorrect. I know this as I was a police officer for 30 years and have dealt with hundreds of shop lifting allegations. It bis to do with mens rea - 'The Guilty Mind' but that must be proven in court after charge.

Far too many wannabe lawyers who haven't a clue about law on here.

I never wore one and never will either. Not only because they don't work because there is nothing for them to stop, but they also release nano plastics and can cause bacterial pneumonia due to build up of Streptococcus after just 20 mins. There are far more reasons that just this too.

That's correct.

@ianhenry4046 I don't have one! But yes, evidence is required and if the do it would be unlawful detention or false imprisonment.
3
@stephenmason5682 The lady was told to empty her bags that's what she said! But to ask for a receipt on its own would prove nothing unless she had an item in her bag she hadn't paid for so they would have to have known what it was first.

@geordiewishart1683 No appropriation until a person has left the store. What about people who put cold food in their own cool bags? Is that theft?
3
@kaymackay3519 So you agree with me then? We both agree on 'mens rea'. Investigation is always required.
3
@michaelward2082 Who do people think they are? Did they consider that a light breeze would render that ridiculous 6 ft pointless? Not withstanding it is pointless anyway. The whole thing was a psy-op.

@LittleKitty22 They are not in power and would never get away with holding such a firearm. Semi-automatics in public are illegal in the UK. 'In the U.K there are very strict laws around the ability to carry weapons, and security guards are not exempt from this. Security guards and bodyguards are not allowed to carry weapons. The law states that security guards cannot carry many of the weapons that guards in other countries can use, such as batons, pepper spray or tasers.'
3
@ianhill4585 That's correct.
2
@stephenmason5682 That's your prerogative mate. But we are simply commenting on the info given.
2
@LittleKitty22 Having been a police officer for 30 years I can tell you security guards are not allowed to carry firearms in the UK, even on enclosed private premises. Only police are allowed to carry automatic weapons and have to be highly trained to do so. We have extremely strict firearms laws in the UK. I can't say anymore than that.
2
That's right I would have called the police too if they wouldn't let me leave and I would have accused them of keeping me hostage. Searching you is illegal only police can do that after reasonable suspicion.
2
@davewright9312 No YOU are talking rubbish. The alleged offender has to leave the store before theft can be proven, that is what we always had to show to even start the process of prosecution. If that cannot be shown then there is no offence of theft. I have a law degree so I know what I am talking about pal, as this is basic stuff.. The intent (Mens rea) cannot even be considered until the person has actually LEFT the premises. It has nothing to do with being 'easier to prove' it is whether they had INTENT. Sorry but the MPS were the leading force in the county and the world when I was in the job pal. Mostly wrong? LOL you sound like someone who has been nicked matey. So can I ask your qualifications?

@JunkyardDog-q1h As I said, proper investigation is absolutely necessary in all cases.
1
@LittleKitty22 That is totally against the law!! Police are the only people allowed to carry weapons, let alone automatic!! Are you sure? I take it this wasn't in the UK?
