  5.  @mzbatonrougebeauty5267  Regardless of the state, in this situation the individual would have to prove that the state did something negligent such as withholding information during discovery or that they did not do something that any other reasonable jurisdiction would have done. Everything I have seen in this case that is not what happened. It is an unfortunate situation, but not negligent.
