  1. So perhaps the US should just do away with Field Sobriety Testing and just go straight to a PBT. You blow 0.00 you walk, you blow over .08 (.05 in Utah) and it's a DWI Arrest.

  2. And many States have what are referred to as "Implied Consent Laws". This means that by opperating a Motor Vehicle in that State you consent to Field Sobriety Testing. If you refuse these tests, the ramifications for refusal are FAR worse than a first Statutory DWI. So telling someone to refuse all testing is bad advise.
