  3. The Cohen case will probably make it to the supreme court who are sticklers for strict legal practise. It will be impossible for the prosecutor to prove that they did not impinge upon Cohens basic rights as a citizen and as a Lawyer. Raiding a sitting lawyers office on half hunches and desires is not going to stand up to scrutiny when it reaches the supreme court and that even includes court orders which will not protect the prosecution's case. All Cohen has to do is sit tight. If Cohen rolls over he will have way out of this what so ever and his ability practice law again will be over.
