That was where I figure the guy was in the wrong. If I were making replacement factor reinstall CDs, I would absolutely label them as such. Have a generic label format I use for everything regardless of manufacturer. Point out it is meant for a specific model/model series, and that no further rights are being ascribed than they'd already have as an owner of some particular hardware. While I'm at it, put in a subtle comment to remind them of how few rights they ARE getting from the manufacturers. And you're not "selling" a disk, you're charging a service/media cost fee. And I expect by adding something about how few rights the manufacturers are giving (with URLs to the EFF, etc) you could probably argue that the disks were a political statement. But pressing them with exact duplicates of the original labeling is misrepresentation. Still, a prison term seems excessive. You have state governors causing thousands of nursing home deaths by gross incompetence and they get to keep their elected positions.

@owlblocksdavid4955 Hey, I use Linux, I work in Linux. The problem is coming down to finding unlocked *HARDWARE*. Apple makes consumer-hostile decisions, and all the other manufacturers follow their bad lead. AND they make sure to make it difficult/near impossible to create competition. Personally I would rather see us fight this by removing the laws/regulations that make the monopolies and such possible, rather than by adding yet more laws. But sometimes that option just isn't possible.

@landonpowell6296 Richard Stallman has little to do with the Linux kernel, userspace, etc. His particular interests in the open source field lie elsewhere.

Well, he was specifically looking at a stack of shipping orders, and saying where those specific orders were being shipped to. Doesn't disprove his statement, as he wasn't implying those were international locations in relation to the USA.

@prepperjonpnw6482 He still could have charged a handling/media fee to cover the cost of the disks and that should have been legal (it's even considered acceptable to charge for the media/processing of open source software disks). As long as that's what the charge was for. The problem was representing them as actual disks from the manufacturer (or even if that wasn't his intent, they appeared to be so).

@glennrishton5679 I think if properly labeled, with a statement that they were not being provided as manufacturer disks but rather as a service for owners of particular hardware, he could have had a better case. As I said on another comment, use it as an opportunity to point out the lack of consumer rights.

Well granted, it does take a bit of training to re-adjust one's voice after transitioning.
