He can't be held criminally liable for the "Lock Her Up" chants unless a criminal act had been perpetrated against Clinton that could have been proven to have been directly instigated by Flynn's words. Otherwise, to arrest him for expressing an opinion would be a blatant violation of the First Amendment.
