Article 1 section 3 clause 7, specifies that only a President impeached by the House and convicted by the Senate is further subject to indictment, trial, judgement, and punishment "by law". He can’t be prosecuted or sued for anything he did during his term as President. Actions as President can only be charged with a crime in an impeachment proceeding. That’s even after the term is over. And it’s too late for any of that. If he breaks the law after his term, then he can be prosecuted or sued.

All of the indictments are based upon activity is legal for the President to do. The President has a legal right to their classified documents after office. The President has the right to disclose and discus any classified information. There was no insurrection nor riot to be incited. There was incitement of an insurrection nor a riot. The president has the legal obligation to question the results of an election. The president may have talked about it, which everyone has the right to do, but did not obstruct anything during the 2020 election.
