  1. It should be noted that this is not exclusively an "Ubuntu" problem, as "needrestart" is not developed specifically for Ubuntu, nor maintained by Canonical. The package is also available on other distros via their package manager, Ubuntu Server just comes with it installed by default.

  3. Your overall point is well taken and generally true for the standard user, but it is possible, and live kernel patching is an actual thing. If you wanted to over-complicate your life, your could never restart and have the upgrades to your packages take effect, including the kernel, libc, systemd, etc, etc.
