  2. You understand the claim to that land was determined to be illegal by our High Court in a 6 to 1 decision. In fact the dodgy nature of “terra nullius” is such that even the poms knew it was suss as they had been creating treaties with other indigenous groups in other parts of their empire by the mid 19th century CE. Yet they kept using “terra nullius” here right up to Federation. Real clever.
