"You can refuse to have a test for gunshot residue?" Yes, you can. "What about if you've had a family member that was killed by a drunk driver? Maybe the driver refused to submit to a test because it could have been used against them?" Here's the thing; driving is not constitutionally protected. You can refuse, but that's an automatic one year suspension. Anything other than loss of driving privileges for refusing to submit to the test(s) (again; driving is not constitutionally protected) is unconstitutional. Any good lawyer will tell you to take the one year hit if you know you're drunk. "What are ypu [sic] truly worried about here?" The United States Constitution, and the rights provided therein. "Do you drink too much and drive a lot and think that's fine because you've never had an accident?" No, but I have been hit by a drunk driver twice. "I was a great drunk driver 20 odd years ago." And? "What are you even arguing for drunk driving to be less easy to do for? [sic]"? What was that supposed to be?
