The reality is that no one cares what you, the person who is looking for a job. What counts how the person hiring thinks. Life is not fair, and yes, you can maybe pursue legal action... but that's not going to get you a job, nor any job in the future once other companies know you have a history of filing lawsuits. What I've found is that when looking for a job unemployed, that carries a huge stigma, of which why aren't you working today... no other company finds any value in your work? Vs if you are currently employed, looking for a job is a lot easier... since you are less stressed about finding work... you have money coming in each payday... and if the company you are applying for, they see that another company values your work, which makes you more desirable. In addition, if you are currently working, and they want to hire you, they may be willing to pay you more... since you aren't desperate for a paycheck.
