- The same person cannot be the President of Ukraine for more than two consecutive terms (Article 103 of the Constitution of Ukraine).
In the event of early termination of the powers of the President of Ukraine, the performance of his duties for the period until the election and assumption of office of a new one is assigned to the Chairman of the Verkhovna Rada of Ukraine (Article 112 of the Constitution of Ukraine).
Features of elections in Ukraine under martial law and extension of powers.
▪ Under martial law, it is prohibited to change the Constitution of Ukraine, to hold elections of the President, the Rada and local government bodies (Article 19, Law of Ukraine No. 389-VIII “On the legal regime of martial law”).
▪ During a martial law or state of emergency, the expired powers of the Verkhovna Rada are automatically extended, as stated in Art. 83 of the Constitution of Ukraine.
▪ At the same time, the Law of Ukraine “On the Legal Regime of Martial Law” does not refer to the automatic extension of the powers of the President. There is only a note that presidential elections are not being held.
in accordance with the Constitution of Ukraine, in conditions of martial law, presidential powers should be exercised by the speaker of the Verkhovna Rada.
