On the surface most would say that Trump could not sue for defamation. The problem they have is that it's part of an ongoing criminal conspiracy, and in this conspiracy they are denying Trump the ability to respond aggressively to rhetorically respond to the people that defame him, including in court. They also deny vigorously the concept of official immunity for official duties, even for the President. So according to this insane cult, she can be sued for criminal or tortious defamation and it can be wrapped up in the Civilian RICO lawsuit Trump must bring. The charge would actually be Deprivation of Rights Under the Color of Law. Conspiracy to deprive rights, obstruct justice, etc. This combines the defamation element with the act of trying to use illegal means to suppress votes. And I would argue that it is also how "the gang" communicates to each other under the supposed protection of "norms of our democracy". They're signaling again that anything goes when it comes to stopping Trump. From local election officials to Biden and every Marxist judge in power or able to blab on CNN and MSNBC. It's a criminal gang and a cult.

@ToxicMan2023 That's not what public figure means. Public figure is anyone recognizable by the public and therefore subject to ordinary gossip. But she is a public official and using her nominal authority to actively participate in a criminal conspiracy to both smear/defame Trump and take him out of consideration for the Presidency using deranged technical arguments. It's a RICO conspiracy to deprive Trump of his Constitutional rights. She's playing an active role because it's not good faith misjudgment. It's criminal malfeasance when you look at her entire campaign against Trump.

@carolchildofgod1467 Qualified immunity is always based on logical inferences, not any specific text. Can Putin sue Trump for blowing up his jets in Syria? Can the survivor of a US attack sue Obama or accuse him of murder for assassinating a US Citizen with a drone strike? They can sue the Federal government for co.pensation under tort law. Not the official doing his job, even if done badly.

The entire reason for propagating "Insurrection" tropes is to signal to all of their operatives that Special Measures are needed for Putin's Puppet/Insurrectionist. They spent more than two full years with Special Insurrection Committee to signal how to proceed after Special Covid Stop Trump measures.

Funny they all claim that VPOTUS has only ceremonial duties when Presiding over the Joint Session to count corrupted Electoral College "certificates". What you guys don't understand is that they're signaling all the criminals/comrades about Special Measures as used in every election since 2016 (but actually this party has always tried to cheat). Every talking point is an attempt to criminalize their targets and exonerate their blatant criminal activities. It's not just that they won't admit what they did in the past. They will never stop until some outside force stops them. Hopefully we can do that without ourselves becoming outlaws.
