The Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA) amended 8 U.S.C. § 1325 to provide that an alien apprehended while entering or attempting to enter the United States at a time or place other than as designated by immigration officers shall be subject to a civil penalty.

The criminal penal code says otherwise but her talking point comes from the fact that if you try to enter illegally and are turned back you are still subject to "civil" penalty AKA a fine or some other penalty that doesn't require a jury trial (or Administrative law court appearance). But this is not for illegal aliens that successfully enter and evade border controls. Those are all unindicted criminals. Or worse.
