  1. Not necessarily. Health and Safety will often come to an "agreement" with a company if the breach is not thought to have been deliberate. The aim is to improve safety rather than punish.

  3.  @chrisk1944  As I said in my first reply "If the offence is not thought to be deliberate". Why would they wish to "punish" unless they saw the original failure as a willful disregard of safety?
