China made a declaration in 2006 in accordance with Article 298 of UNCLOS that excludes acceptance of compulsory dispute settlements concerning maritime delimitation, historic bays or titles, as well as military and law enforcement activities from the dispute settlement procedures provided for in UNCLOS. In other words China does not accept the PCA settlement because it excludes acceptance as provided in the UNCLOS convention.

@LivingLonger Philippines didn't even bring the case to court. It was Washington DC based law firm Foley Hoag LLP who knew about the 2006 declaration China made under article 298 of UNCLOS, but proceeded with the case anyway. It was a concerted effort by operatives within the US government to escalate tensions in the South China Sea.

@Sean-giang By making the declaration China is not bound by the terms of the dispute settlement procedures, therefore the piece of paper from the PCA is worthless and all of this is legal under the UNCLOS convention...🤣

@LivingLonger We are talking about the same case. It was actually the Obama administration that persuaded the Aquino government to initiate the case with Foley Hoag LLP against China at the PCA. It was part of the "Pivot to Asia" strategy implemented by Obama in 2011.
