@Iceaxe0410 President's already have immunity for things they did within the scope of their office, Jack's argument is that Trump's criminality was outside the scope of his office

@Tyler_W That wouldn't be a ruling, that would be the supreme court just making laws, which they obviously don't have the right to do
1
No, a sitting president would only be vulnerable to legal repercussions if he engaged in criminal behaviour outside of his official duties like Trump is alleged to have done
1
That's a small part of the crimes alleged tho, Smith is also charging Trump with the false elector scheme, the plot to steal voting machines, pressuring foreign secretaries of state to find ballots after the election and so on
1
@andrewswift2683 There isn't much of a constitutional crisis here tho, president's are not kings
1
@HBFTimmahh where does it say that in the constitution or case law?
1
@joannleichliter4308 A president can only be threatened with future prosecution if they acted criminally outside of their official duties like Trump is alleged to have done. So future president's would not be vulnerable to prosecution
1
@debanydoombringer1385 it wouldn't turn us into a banana republic to make presidents who act criminally outside of their official duties vulnerable to prosecution. It's a much needed check on executive power
1
@seansimmons73 there's nothing in the constitution preventing criminal prosecution for crimes conducted while in office. It won't invite moral hazard because you need evidence to impeach anyone, if there's evidence the president acted unlawfully outside of his official duties, then he should face accountability
1
political punishments like impeachment have nothing to do with the criminal justice system
1
there really isn't a constitutional crisis, president arent kings
1
@RichardDanielli If the grounds were indeed as flaky as you claim, Trump should be hoping for a speedy trial instead of delaying so aggressively
1
they obviously can, this is just to speed up trump's delay tactics
