 @beezo1764 — True, there are some states that don’t have single party consent laws. I was referring to federal wiretapping laws set (initially phrased or framed) by Judge Greene when he split up AT&T into the Ma’ Bells way back when. Roughly (from memory) said ‘Any party in a telephone conversation has a reasonable expectation of privacy, any third party not involved in a conversation may not record the conversation without a court order.’ (sic) That phrase (reasonable expectation of privacy) has been used and broadened to include video. If you are walking along and take video with your phone of a police officers actions yourself, that’s legal, because you are there and they are in public. If you leave your phone in an officers car recording, that’s a no-no (inadmissible) as they are not in public and you are not present. But you are correct, and you presented something I hadn’t considered, it was a conference call, the participants could have been in any state or country. In which case you have just exceeded my limited knowledge. 🤓 I concede.

And many will remember only that he used the N-word. Any professional knows better, has learned better, and has ruled that word out from their vocabulary with red ink.

A lawsuit for breach of contract would be unfeasible as the Public Relations company Laundry Service would argue they represented the company, not the CEO, and their recommendation was appropriate based on rebounding stock prices. As a party on the call, they or anyone on the call could have recorded the call. Their only saving grace in the lawsuit would be if someone in the company recorded the call who was not actively included on the call, that would violate wiretapping laws.
