All I know is in Texas, if he did that (as others have) you will be charged with manslaughter, you will be charged with discharging a firearm, and the families always find a lawyer to sue the person who took the shooter out. A whole industry of insurance for CHL holders has sprung up as a result. If you shoot someone in self defense, or in defense of others, you will be sued.
