  1.  @ineedhoez  Boxer gets into a ring but assumes that the judge will be fair and opponent will not have gloves with steel inserts. The usual standard that will be done is "what would most people in the industry do". By that marker company waver is a joke it will not stand even for a day in court. I.e. risk of injury is of course there but it cannot be caused by the Ocean Gate behavior that is unreasonable. Or to put it the other way, accidents happen --- this is what waver protects from. Problem is this was no accident as company deviated from "standard" procedures of the industry. In rock climbing injuries and death do happen. Wavers are all over the place. But they do not protect when the guide does something plain stupid. They only protects vs. acts of God. Unforeseen events. Etc.

  2. Waver in US court would be thrown out on day one. Company is done for. You cannot wave away gross negligence. The law in use is supposedly Bahamas. There is no money in the company anyways.

  3. accident was foreseeable and preventable b/c previous sub ideas with CF were one time use and prevention was to re do the hull.
