Cop says he was trying to protect the patient. What is cop trying to protect patient from? Was patient suspected of DUI? If so then what is the reasonable articulable suspicion of DUI? Answer: THERE IS NO evidence that patient was at fault, let alone was impaired, because patient was hit head on by fleeing criminal. So there is NO legal justification for drawing his blood; the patient is PRESUMED INNOCENT and does not need to prove his blood is clean. If cop had suspicions he should've gotten a warrant. That he tried to sidestep this raises questions about his knowledge of the law, his intentions, or both.
