  1. Judge Napolitano is right. The federal government has no right to prosecute such cases. Congress has usurped State rights and has passed unconstitutional laws making acts which take place within a State federal crimes when congress under the constitution has only the power to regulate commerce with foreign nations and among the several States. , power over maritime laws and treaties with Indian tribes. Commerce Clause The clause states that the United States Congress shall have power "To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes." ONLY REGULATE' COMMERCE. Those scumbags in congress want to make anything a federal crime when in fact they have no power under the constitution to do it. This goes also for the Second Amendment and laws passed by congress to regulate it by punishing certain people when there is no authority expressed or implied in the Second Amendment for congress to pass laws on who can or cannot possess a firearm. My advice to those charged under federal laws is not to plead guilty and to go to trial instead and advice the jury about the unconstitutionality of the law under which they were charged. Educate yourselves and fight for your rights. Also the Plea Bargain System used in federal and State Courts. Totally unconstitutional for people charge for a criminal offense. Twice: Once in the constitution itself and then in the article of the Amendment to the Constitution it clearly says that all criminal trials shall be by jury. It doesn't mention at all "Trials By Plea Bargains". Fight back.
