The judge is technically correct (the best kind), because as long as the actual amount is printed on the box, well it's printed on the box and doesn't matter how the packaging looks like. However, just because this is true, it doesn't mean that the company itself isn't trying to scam customers and their monkey brains. I think the most direct investigation of such claims would be to, well check for the exemptions the regulation/standard says later. If the packaging needed special adjustments for it to contain more slack-fill, then that means someone decided to spend money on making the container look bigger than necessary. Changes done to machining is expensive.
