  2. Alex W this is not a Jury trial and I am certain the Judge is capable of weighing up the evidence .H is one of 5 people taking this legal action.

  5.  @dede4004  I don't think the rules are dramatically different in the US Courts .This is not a Jury trial and the Judge can exercise some latitude if he wishes.I can only suggest you wait to read his Judgement.
